{"id":4293,"date":"2018-04-25T17:45:20","date_gmt":"2018-04-25T17:45:20","guid":{"rendered":"http:\/\/www.jahalin.org\/?p=4293"},"modified":"2018-05-12T17:50:04","modified_gmt":"2018-05-12T17:50:04","slug":"4293-2","status":"publish","type":"post","link":"https:\/\/www.jahalin.org\/archive\/?p=4293","title":{"rendered":"Israel: Army Demolishing West Bank Schools Could Amount to War Crimes"},"content":{"rendered":"<figure class=\"embed node node-image align-right multimedia\"><figcaption class=\"figure-info clearfix\"><\/figcaption><\/figure>\n<p>(New York, April 25, 2018) \u2013\u00a0<a href=\"https:\/\/www.hrw.org\/middle-east\/n-africa\/israel\/palestine\">Israel<\/a>\u00a0has repeatedly denied Palestinians permits to build schools in the West Bank and demolished schools built without permits, making it more difficult or impossible for thousands of children to get an education, Human Rights Watch said today. On April 25, 2018, Israel\u2019s high court will hold what may be the final hearing on the military\u2019s plans to demolish a school in Khan al-Ahmar Ab al-Hilu, a Palestinian community. It is one of the\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/Demolition_report_20_03_2018_final.pdf\" target=\"_blank\" rel=\"noopener\">44 Palestinian schools<\/a>\u00a0at risk of full or partial demolition because Israeli authorities say they were built illegally.<\/p>\n<div class=\"embed\" data-type=\"image\">The Israeli military refuses to permit most new Palestinian construction in the 60 percent of the West Bank where it has exclusive control over planning and building, even as the military facilitates settler construction. The military has enforced this discriminatory system by razing thousands of Palestinian properties, including schools, creating pressure on Palestinians to leave their communities. When Israeli authorities have demolished schools, they have not taken steps to ensure that children in the area have access to schools of at least the same quality.<\/div>\n<p>\u201cIsraeli authorities have been getting away for years with demolishing primary schools and preschools in Palestinian communities,\u201d said\u00a0<a href=\"https:\/\/www.hrw.org\/about\/people\/bill-van-esveld\">Bill Van Esveld<\/a>, senior children\u2019s rights researcher at Human Rights Watch. \u201cThe Israeli military\u2019s refusal to issue building permits and then knocking down schools without permits is discriminatory and violates children\u2019s right to education.\u201d<\/p>\n<p>Israeli military authorities have demolished or confiscated Palestinian school buildings or property in the West Bank at least 16 times since 2010, with 12 incidents since 2016, repeatedly targeting some schools, Human Rights Watch found. Over a third of Palestinian communities in Area C, the 60 percent of the West Bank where the Israeli military has exclusive control over building under the 1993 Oslo accords, currently\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/access-education-area-c-west-bank\" target=\"_blank\" rel=\"noopener\">do not have primary schools<\/a>, and\u00a0<a href=\"https:\/\/unsco.unmissions.org\/sites\/default\/files\/cca_report_en.pdf\" target=\"_blank\" rel=\"noopener\">10,000 children<\/a>\u00a0attend school in tents, shacks, or other structures without heating or air-conditioning, according to the UN. About 1,700 children had to walk five or more kilometers to school due to road closures, lack of passable roads or transportation, or other problems,\u00a0<a href=\"https:\/\/unsco.unmissions.org\/sites\/default\/files\/cca_report_en.pdf\" target=\"_blank\" rel=\"noopener\">according<\/a>\u00a0to 2015 UN estimates. The long distances and fear of harassment by settlers or the military lead some parents to take their children out of school, with a\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2017\/10\/10\/human-rights-watch-submission-cedaw-committee-israels-periodic-report-68th-session\">disproportionate impact on girls<\/a>.<\/p>\n<p>\u201cThe school has become the lifeline for this and the five surrounding communities,\u201d said a community leader in Khan al-Ahmar Ab al-Hilu, known as Abu Khamis, about a school under threat of demolition that was built with humanitarian aid. The school also offers literacy instruction for adults. He said that children previously had to travel 15 to 22 kilometers to school, but that now, \u201cA child can go to school without risking accidents or dealing with [taxi drivers] and the city. Now all girls go to school.\u201d He said that the international community had helped build the school and added, \u201cIs the international community unable to protect it?\u201d<\/p>\n<p>Most West Bank\u00a0<a href=\"https:\/\/972mag.com\/demolishing-palestinian-schools-a-quiet-population-transfer\/132662\/\" target=\"_blank\" rel=\"noopener\">schools at risk of demolition<\/a>\u00a0fall within Area C. Israel justifies its demolition of\u00a0<a href=\"https:\/\/public.tableau.com\/profile\/ocha.opt#!\/vizhome\/Education-VPP\/DashEducation\" target=\"_blank\" rel=\"noopener\">schools<\/a>\u00a0and other Palestinian property there not on security grounds, but rather on the grounds that they were built without permits from the military. However, the military\u00a0<a href=\"https:\/\/972mag.com\/israel-issuing-palestinian-building-permits-to-further-west-bank-land-grab\/124815\/\" target=\"_blank\" rel=\"noopener\">refuses the vast majority<\/a>\u00a0of Palestinian building requests, and has\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/demolition_orders_in_area_c_of_the_west_bank_en.pdf\" target=\"_blank\" rel=\"noopener\">zoned only 1 percent of Area C<\/a>\u00a0for Palestinian building, even as construction proceeds with few constraints in nearby Jewish settlements.<\/p>\n<p>A Palestinian community leader in the Jordan Valley, Abu Sakker,\u00a0<a href=\"https:\/\/www.hrw.org\/report\/2010\/12\/19\/separate-and-unequal\/israels-discriminatory-treatment-palestinians-occupied#bb87cf\">told Human Rights Watch<\/a>\u00a0that Israeli restrictions had reduced three communities that had a total of 150 families in 1997 to 45 families in 2010.\u00a0<em>Haaretz<\/em>\u00a0<a href=\"https:\/\/www.haaretz.com\/1.5037003\" target=\"_blank\" rel=\"noopener\">reported<\/a>\u00a0in 2010 that Israeli demolitions and the de facto ban on construction had led 180 families \u2013 up to 1,000 people \u2013 to leave Jiftlik, the largest Palestinian community in Area C. A Palestinian refugee rights group, Badil, documented\u00a0<a href=\"https:\/\/reliefweb.int\/sites\/reliefweb.int\/files\/resources\/FT-Coercive-Environments-2.pdf\" target=\"_blank\" rel=\"noopener\">cases of forcible transfer<\/a>\u00a0in a 2017 report.<\/p>\n<p>Schools in three Palestinian communities in Area C, east of Jerusalem, are at particular risk. Israeli authorities are trying to demolish trailers used as a preschool for 25 children in\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/jabal%20al-baba.htm\" target=\"_blank\" rel=\"noopener\">Jabal al-Baba<\/a>\u00a0that replaced a building the military dismantled in August 2017. Israeli settlers have repeatedly petitioned the courts to order the military to demolish the school in\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/Abu%20Al-Helw%20and%20Um%20Ad-Deif.htm\" target=\"_blank\" rel=\"noopener\">Khan al-Ahmar Ab al-Hilu<\/a>, the only school accessible to 160 children from five villages in the area. The Israeli military is trying to move the residents to a different area over their strong objections. In\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/al%20muntar.htm\" target=\"_blank\" rel=\"noopener\">al-Muntar<\/a>, Israel\u2019s high court has rejected a petition challenging a demolition order against the school and issued an injunction against using the school. A new petition, demanding that the military assesses a building plan submitted by the village\u2019s residents, is still pending in court. The court temporarily enjoined the military from demolishing the school and scheduled a hearing for July 1.<\/p>\n<p>The three communities are among\u00a0<a href=\"https:\/\/reliefweb.int\/sites\/reliefweb.int\/files\/resources\/G1600802.pdf\" target=\"_blank\" rel=\"noopener\">46 Palestinian communities<\/a>\u00a0that the UN considers at \u201c<a href=\"https:\/\/www.ochaopt.org\/page\/46-bedouin-communities-risk-forcible-transfer-central-west-bank-vulnerability-profile\" target=\"_blank\" rel=\"noopener\">high risk of forcible transfer<\/a>\u201d due to an Israeli \u201crelocation\u201d plan that would forcibly evict the entire communities.<\/p>\n<p>The school demolitions are consistent with other actions that make communities unviable, such as home demolitions, and the refusal to zone the communities or grant them connections to utilities like water and electricity, Human Rights Watch said. Since Prime Minister Benjamin Netanyahu took office on March 31, 2009, Israeli forces have demolished 5,351 Palestinian buildings in the West Bank for lack of building permits, including East Jerusalem, displacing 7,988 people, including more than 4,100 children, based on UN\u00a0<a href=\"https:\/\/app.powerbi.com\/view?r=eyJrIjoiOGFlMmRhYjgtYmMxMC00YTYyLTg3ZmEtZGY1ZDExODk5ZDU5IiwidCI6IjBmOWUzNWRiLTU0NGYtNGY2MC1iZGNjLTVlYTQxNmU2ZGM3MCIsImMiOjh9\" target=\"_blank\" rel=\"noopener\">data<\/a>. Israel has not offered resettlement options or compensation to families whose homes were demolished during this period.<\/p>\n<p>Israel\u2019s destruction of Palestinian schools, and its failure to replace them, violates its obligation as\u00a0<a href=\"https:\/\/ihl-databases.icrc.org\/applic\/ihl\/ihl.nsf\/Article.xsp?action=openDocument&amp;documentId=E09D15BDEC76F8D9C12563CD0051BDCC\" target=\"_blank\" rel=\"noopener\">an occupying power<\/a>\u00a0to \u201cfacilitate the proper working of all institutions devoted to the care and education of children,\u201d and violates the prohibition on\u00a0<a href=\"https:\/\/ihl-databases.icrc.org\/applic\/ihl\/ihl.nsf\/1a13044f3bbb5b8ec12563fb0066f226\/41266ebf07176fefc12563cd0042c4ce\" target=\"_blank\" rel=\"noopener\">interfering<\/a>\u00a0with the activities of educational institutions or requisitioning their property. International law\u00a0<a href=\"https:\/\/ihl-databases.icrc.org\/applic\/ihl\/ihl.nsf\/Article.xsp?action=openDocument&amp;documentId=74DEE157D151F7EAC12563CD0051BE1B\" target=\"_blank\" rel=\"noopener\">prohibits<\/a>\u00a0an occupying power from destroying property, including schools, unless \u201cabsolutely necessary\u201d for \u201cmilitary operations.\u201d The Fourth Geneva Convention and the Rome Statute of the International Criminal Court prohibit widespread, unlawful destruction of property as a war crime.<\/p>\n<p>The intentional forcible transfer of civilians within an occupied territory \u2013 the movement of people under duress to a place not of their choosing \u2013 is also a grave breach of the laws of war. The Rome Statute states that forcible transfer can occur \u201cdirectly or indirectly,\u201d through coercive circumstances as well as direct force. Israel\u2019s demolitions of schools are part of a policy that has forced Palestinians to leave their communities.<\/p>\n<p>Parties to the Geneva Conventions are obliged to \u201censure respect\u201d for the law of occupation, and to prosecute \u201cgrave breaches\u201d \u2013 including the war crimes of wanton destruction and forcible transfer \u2013 regardless of the country in which the crimes took place. Countries should investigate individuals whom evidence suggests may be responsible for these crimes and prosecute those over whom they have jurisdiction. The International Criminal Court prosecutor should also examine the school demolitions as part of her\u00a0<a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=180408-otp-stat\" target=\"_blank\" rel=\"noopener\">ongoing preliminary examination<\/a>\u00a0into the situation in Palestine.<\/p>\n<p>The European Union or its member states financially\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/Demolition_report_20_03_2018_final.pdf\" target=\"_blank\" rel=\"noopener\">supported<\/a>\u00a021 of the 36 schools in Area C of the West Bank that are at risk of demolition. The other at-risk schools are in East Jerusalem. Hundreds of the structures Israel has demolished were financed by\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/record-number-demolitions-and-displacements-west-bank-during-2016\" target=\"_blank\" rel=\"noopener\">foreign donors<\/a>, including 400\u00a0<a href=\"https:\/\/eeas.europa.eu\/sites\/eeas\/files\/20171004_palestine_-_six-month_report_on_demolitions_and_confiscations_of_eu_funded_structures_in_the_west_bank_including_east_jerusalem_annex.pdf\" target=\"_blank\" rel=\"noopener\">European<\/a>-funded structures.<\/p>\n<p>\u201cIsraeli officials should be on notice that razing dozens of Palestinian schools not only can block children from getting an education, but may be an international crime,\u201d Van Esveld said. \u201cAs part of their efforts to support Palestinian schools, other countries should demand that those destroying schools should be held to account.\u201d<\/p>\n<p><strong>For more details about the schools at risk of demolition, a timeline of recent school demolitions, and the applicable international law, see below.<\/strong><\/p>\n<p><strong>Khan al-Ahmar Ab al-Hilu<\/strong><\/p>\n<p>About 180 people, including 90 children, live in\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/Abu%20Al-Helw%20and%20Um%20Ad-Deif.htm\" target=\"_blank\" rel=\"noopener\">Khan al-Ahmar Ab al-Hilu<\/a>, a community east of Jerusalem established in the early 1950s \u2013 before Israel occupied the West Bank \u2013 by Bedouin Palestine refugees from the Negev desert. Israeli military planning documents do not recognize the community as a residential area, and allocate its land to the large, neighboring settlement of Maale Adumim. Israeli authorities have on\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/index.htm\" target=\"_blank\" rel=\"noopener\">many occasions<\/a>\u00a0since the 1980s confiscated land, demolished buildings, and expelled Palestinian residents from the Khan al-Ahmar area.<\/p>\n<p>In 2016 Israeli authorities\u00a0<a href=\"https:\/\/www.btselem.org\/facing_expulsion_blog?community=204521&amp;nid\" target=\"_blank\" rel=\"noopener\">demolished 12 buildings<\/a>\u00a0in the community that were built without permits, leaving 60 people homeless, and in March 2017\u00a0<a href=\"https:\/\/www.btselem.org\/facing_expulsion_blog?community=204521&amp;nid\" target=\"_blank\" rel=\"noopener\">issued demolition orders<\/a>\u00a0for\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/tightening-coercive-environment-bedouin-communities-around-ma-ale-adumim-settlement\" target=\"_blank\" rel=\"noopener\">every structure<\/a>\u00a0in Khan al-Ahmar Ab al-Hilu. The military is planning to\u00a0<a href=\"https:\/\/www.haaretz.com\/opinion\/editorial\/stop-the-forced-uprooting-of-bedouin-from-the-west-bank-1.5452860\" target=\"_blank\" rel=\"noopener\">forcibly relocate the residents<\/a>\u00a0to a site near a municipal garbage dump, which Israel calls \u201cJabal West,\u201d Israeli defense minister Avigdor Lieberman\u00a0<a href=\"https:\/\/www.haaretz.com\/israel-news\/israeli-defense-chief-blasts-radical-settler-youth-as-disturbed-idiots-1.5446702\" target=\"_blank\" rel=\"noopener\">told journalists<\/a>\u00a0in August 2017. Residents\u00a0<a href=\"https:\/\/972mag.com\/israel-issuing-palestinian-building-permits-to-further-west-bank-land-grab\/124815\/\" target=\"_blank\" rel=\"noopener\">are resisting<\/a>\u00a0because they were not consulted, the new site is on land\u00a0<a href=\"https:\/\/www.unrwa.org\/userfiles\/2013052935643.pdf\" target=\"_blank\" rel=\"noopener\">taken from other Palestinians<\/a>, and the plan would not be economically or socially viable due to their\u00a0<a href=\"https:\/\/www.unrwa.org\/userfiles\/2013052935643.pdf\" target=\"_blank\" rel=\"noopener\">pastoral way of life<\/a>.<\/p>\n<p>Separately, associations from three Israeli settlements have\u00a0<a href=\"https:\/\/www.btselem.org\/communities_facing_expulsion\/khan_al_ahmar\" target=\"_blank\" rel=\"noopener\">repeatedly petitioned<\/a>Israel\u2019s High Court of Justice to order the demolition of the Khan al-Ahmar Ab al-Hilu primary school, which a foreign nongovernmental group helped construct in 2009 using 2,200 tires and mud mixed with falafel oil. The school serves 160 children, including children from other Bedouin communities in the area. Before the school was built, children had to travel long distances to school in Jericho, or walk on a hazardous path next to a busy highway, Route 1, to get to school;\u00a0<a href=\"https:\/\/www.timesofisrael.com\/unwanted-by-israel-and-the-pa-bedouin-have-nowhere-to-go-but-up-in-the-air\/\" target=\"_blank\" rel=\"noopener\">two children<\/a>\u00a0from the community were fatally struck by cars.<\/p>\n<p>The military issued a demolition order for the school upon its completion, and\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-report-21-february-6-march-2017\" target=\"_blank\" rel=\"noopener\">several times<\/a>\u00a0since, but has not carried them out. Nearby settlements have\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/UNICEF_Under_Occupation_final-SMALL.pdf\" target=\"_blank\" rel=\"noopener\">petitioned for the military to enforce the orders<\/a>. Israel\u2019s High Court will hear the settlers\u2019 petition, which Israel\u2019s state attorney supports, at the same time as it hears a petition by Khan al-Ahmar Ab al-Hilu\u2019s residents against the military\u2019s plans to demolish the village, and is expected to rule on both on April 25.<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.timesofisrael.com\/unwanted-by-israel-and-the-pa-bedouin-have-nowhere-to-go-but-up-in-the-air\/\" target=\"_blank\" rel=\"noopener\">number of settlers<\/a>\u00a0from Kfar Adumim have recently lobbied\u00a0<a href=\"http:\/\/www.themilitant.com\/2018\/8213\/821353.html\" target=\"_blank\" rel=\"noopener\">to support<\/a>\u00a0the Bedouin community. One of the judges who has held hearings on the case,\u00a0<a href=\"https:\/\/www.haaretz.com\/israel-news\/supreme-court-justice-attended-controversial-settlements-jubilee-ceremony-1.5455352\" target=\"_blank\" rel=\"noopener\">Noam Sohlberg<\/a>, lives in a different settlement.<\/p>\n<p><strong>Al-Muntar<\/strong><\/p>\n<p>Israeli forces confiscated prefabricated classrooms and other infrastructure at the elementary school in the Bedouin refugee community of\u00a0<a href=\"https:\/\/www.nrc.no\/news\/two-more-palestinian-schools-under-threat\/\" target=\"_blank\" rel=\"noopener\">al-Muntar<\/a>, in Area C east of Jerusalem, in August 2017. The community has about 100 school-age children. The school was intended to serve 70 children and currently has 33, ages 5 to 11. The others walk more than\u00a0<a href=\"https:\/\/www.haaretz.com\/israel-news\/.premium.MAGAZINE-school-could-be-out-forever-for-these-bedouin-kids-1.5788378?=&amp;utm_source=General%2BMailling%2BList&amp;utm_campaign=ef082f298f-EMAIL_CAMPAIGN_2018_02_06&amp;utm_medium=email&amp;utm_term=0_586030c60d-ef082f298f-58731609&amp;ts=_1518013876010\" target=\"_blank\" rel=\"noopener\">two kilometers each way<\/a>\u00a0over steep and rough desert terrain, to the nearest elementary school \u2013 in\u00a0<a href=\"https:\/\/unispal.un.org\/DPA\/DPR\/unispal.nsf\/0\/128F71C7AE1F4FD38525798700564934\" target=\"_blank\" rel=\"noopener\">Wadi Abu Hindi<\/a>\u00a0\u2013 which also has a pending demolition order.\u00a0<em>Haaretz<\/em>\u00a0newspaper\u00a0<a href=\"https:\/\/www.haaretz.com\/israel-news\/.premium.MAGAZINE-school-could-be-out-forever-for-these-bedouin-kids-1.5788378?=&amp;utm_source=General%2BMailling%2BList&amp;utm_campaign=ef082f298f-EMAIL_CAMPAIGN_2018_02_06&amp;utm_medium=email&amp;utm_term=0_586030c60d-ef082f298f-58731609&amp;ts=_1518013876010\" target=\"_blank\" rel=\"noopener\">reported<\/a>\u00a0that although residents have lived in al-Muntar since before the state of Israel was established, the Israeli military never recognized it or zoned it for residential construction.<\/p>\n<p>The lawyer representing the residents, Yotam Ben Hillel, told Human Rights Watch that in late 2016, the military issued stop-work orders against the school and a preschool next to it that had opened in 2013 on the grounds that they lacked building permits. The military subsequently rejected the community\u2019s application for a building permit and ordered the school\u2019s demolition. The community appealed to the High Court of Justice, saying the demolition would unduly harm the children\u2019s right to an education.<\/p>\n<p>The High Court ordered a halt to construction work on the school and then\u00a0<a href=\"https:\/\/supremedecisions.court.gov.il\/Home\/Download?path=HebrewVerdicts\\18\\230\\009\\m01&amp;fileName=18009230.M01&amp;type=2\" target=\"_blank\" rel=\"noopener\">dismissed the residents\u2019 petition<\/a>\u00a0in December 2017, stating that the school had been built without authorization, construction had continued despite the stop-work order, and that the court\u2019s temporary injunction against demolition would expire on February 1.<\/p>\n<p>On January 25, the community submitted a detailed construction plan to the military, hoping it would finally lead to obtaining permits. The community also asked the court to extend the injunction against demolishing the school until the military replied. On March 28, the state attorney\u2019s office asked the court to reject the community\u2019s building plan for the school and lift the injunction on the demolition. The state attorney also asked the court to order the community to pay the government\u2019s court expenses. The court did not lift the temporary injunction and scheduled a hearing for July 1.<\/p>\n<p>Israeli authorities have issued demolition orders for\u00a0<a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/jahalin\/al%20muntar.htm\" target=\"_blank\" rel=\"noopener\">every structure<\/a>\u00a0in the community. Israel\u2019s state attorney has said in court that apart from the school, the demolition of other buildings in al-Muntar is not currently a \u201cpriority\u201d and that residents could appeal future demolitions. However, the demolition orders remain valid, and no new structures may be built.<\/p>\n<p><strong>Timeline of Recent School Demolitions<\/strong><\/p>\n<p>Israeli forces have demolished or confiscated Palestinian classrooms, playgrounds, or school-related water and electricity infrastructure at least 16 times since 2010:<\/p>\n<p>2018<\/p>\n<ul>\n<li>On April 9, Israeli authorities\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-report-27-march-9-april-2018\" target=\"_blank\" rel=\"noopener\">confiscated trailers<\/a>\u00a0used as preschool and primary school classrooms for 42 children in\u00a0<a href=\"https:\/\/www.haaretz.com\/demolition-danger-for-village-on-ancient-site-1.5271683\" target=\"_blank\" rel=\"noopener\">Khirbet Zanuta<\/a>, an isolated community in the southern West Bank. The school buildings were set up in March. The Israeli military is seeking to forcibly evict the village\u2019s residents after it declared the area is an\u00a0<a href=\"https:\/\/www.btselem.org\/south_hebron_hills\/zanutah\" target=\"_blank\" rel=\"noopener\">archaeological site<\/a>.<\/li>\n<li>On April 11, Israeli authorities told residents of\u00a0<a href=\"https:\/\/972mag.com\/in-jabal-al-baba-the-trees-are-protected-but-the-people-arent\/131903\/\" target=\"_blank\" rel=\"noopener\">Jabal al-Baba<\/a>, in the E1 area east of Jerusalem, that they would demolish a portable building built in late March as a preschool for 25 children. The community\u2019s lawyer appealed to the Israeli military, and was told that if her appeal is denied the kindergarten will be demolished on April 22. Israeli forces had previously dismantled and confiscated a\u00a0<a href=\"http:\/\/www.btselem.org\/press_releases\/20170822_israel_demolishes_school_in_jub_a_dib\" target=\"_blank\" rel=\"noopener\">prefabricated classroom<\/a>\u00a0and classroom furniture at a\u00a0<a href=\"http:\/\/www.maannews.com\/Content.aspx?id=778784\" target=\"_blank\" rel=\"noopener\">kindergarten<\/a>\u00a0built by the community In August 2017.<\/li>\n<li>On February 4, Israel demolished\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/statement-acting-humanitarian-coordinator-opt-roberto-valent-israeli-authorities-destruction\" target=\"_blank\" rel=\"noopener\">two primary school classrooms<\/a>\u00a0in\u00a0<a href=\"http:\/\/www.maannews.com\/Content.aspx?id=770387\" target=\"_blank\" rel=\"noopener\">Abu Nuwar<\/a>, east of Jerusalem \u2013 one of the 46 Palestinian villages in the West Bank targeted by the \u201crelocation\u201d plan. Israeli authorities have gone to the school as often as three times a week since January, often taking photographs or questioning residents.\u00a0<a href=\"https:\/\/www.humanitarianresponse.info\/sites\/www.humanitarianresponse.info\/files\/assessments\/protecting_education_under_attack_-_abu_nuwar.pdf\" target=\"_blank\" rel=\"noopener\">Since 2016<\/a>, Israeli forces have\u00a0<a href=\"http:\/\/www.middleeasteye.net\/news\/israeli-forces-demolish-sole-primary-school-jerusalem-bedouin-community-1150527615\" target=\"_blank\" rel=\"noopener\">confiscated<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/Annual_CAAC_Bulletin_2016_FINAL_22Dec2017.pdf\" target=\"_blank\" rel=\"noopener\">demolished<\/a>\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/statement-acting-humanitarian-coordinator-opt-roberto-valent-israeli-authorities-destruction\" target=\"_blank\" rel=\"noopener\">donor-funded primary<\/a><a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-weekly-report-1-14-august-2017\" target=\"_blank\" rel=\"noopener\">school classrooms and solar panels<\/a>\u00a0in Abu Nuwar eight times, and demolished the homes\u00a0<a href=\"https:\/\/www.ochaopt.org\/page\/46-bedouin-communities-risk-forcible-transfer-central-west-bank-vulnerability-profile\" target=\"_blank\" rel=\"noopener\">of 26 people<\/a>. The UN Special Coordinator for the Middle East Peace Process, Nickolay Mladenov,\u00a0<a href=\"https:\/\/unsco.unmissions.org\/briefing-security-council-situation-middle-east-%E2%80%93-report-unscr-2334-2016-0\" target=\"_blank\" rel=\"noopener\">told<\/a>\u00a0the Security Council that Israel has applied \u201csteady pressure\u201d on Abu Nuwar residents to move because their community \u201cis in the strategic E1 area planned for the expansion of Ma\u2019ale Adumim,\u201d a large settlement. Khan al-Ahmar is also in the E1 area.<\/li>\n<\/ul>\n<p>2017<\/p>\n<ul>\n<li>In December, Israeli authorities notified the high court that they intend to\u00a0<a href=\"https:\/\/www.timesofisrael.com\/state-doubles-number-of-buildings-slated-for-immediate-demolition-in-susya\/\" target=\"_blank\" rel=\"noopener\">demolish every structure in Khirbet Susya<\/a>, in the southern West Bank, including its only school.\u00a0<a href=\"https:\/\/www.btselem.org\/index.php\/south_hebron_hills\/susiya\" target=\"_blank\" rel=\"noopener\">Beginning in 1986<\/a>, the military has repeatedly demolished residences, closed water wells, and forcibly evicted residents, claiming it is an \u201carchaeological site.\u201d<\/li>\n<li>In August, Israeli forces seized\u00a0<a href=\"https:\/\/www.nrc.no\/news\/2017\/august\/israel-demolishes-palestinian-schools-days-before-reopening\/\" target=\"_blank\" rel=\"noopener\">six donor-funded trailers used as classrooms<\/a>\u00a0in Jubbet al-Dhib, near Bethlehem,\u00a0<a href=\"http:\/\/www.independent.co.uk\/news\/world\/middle-east\/israel-destroys-palestinian-schools-before-new-term-occupied-west-bank-jub-ad-dhib-a7910356.html\" target=\"_blank\" rel=\"noopener\">the day before<\/a>\u00a0the new primary school was due to open for 64 students. Residents used\u00a0<a href=\"http:\/\/www.maannews.com\/Content.aspx?id=779029\" target=\"_blank\" rel=\"noopener\">concrete blocks<\/a>\u00a0to rebuild five classrooms, but Israeli forces returned in early September and seized building tools, and used\u00a0<a href=\"http:\/\/www.maannews.com\/Content.aspx?id=779041\" target=\"_blank\" rel=\"noopener\">teargas and stun grenades<\/a>\u00a0against residents who protested. Residents had begun work on water and sanitation for the school in March, but the military issued a \u201cstop work\u201d order in April. Authorities have\u00a0<a href=\"https:\/\/www.hrw.org\/report\/2010\/12\/19\/separate-and-unequal\/israels-discriminatory-treatment-palestinians-occupied#52e1ba\">refused to connect the village<\/a>\u00a0to the\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/middle_east\/20-minutes-from-modern-jerusalem-a-palestinian-village-is-stranded-in-the-past\/2016\/10\/19\/9ec8ef38-8cdd-11e6-8cdc-4fbb1973b506_story.html?utm_term=.8ab6b48e2b8e\" target=\"_blank\" rel=\"noopener\">electric grid for decades<\/a>. In June, they seized 96\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/middle_east\/this-palestinian-village-had-solar-power--until-israeli-soldiers-took-it-away\/2017\/07\/05\/d4b8a5fc-6036-11e7-a4f7-af34fc1d9d39_story.html?noredirect=on&amp;utm_term=.59aefe8b139f\" target=\"_blank\" rel=\"noopener\">solar panels<\/a>\u00a0donated by the\u00a0<a href=\"http:\/\/nltimes.nl\/2017\/06\/30\/israel-destroys-dutch-development-project-netherlands-furious\" target=\"_blank\" rel=\"noopener\">Dutch government<\/a>, stating they were installed without permits, but later returned them. Residents told Human Rights Watch that children had dropped out of school because of the difficulty of walking to schools in other villages, and that several families left the village because of harsh living conditions created by Israeli restrictions.<\/li>\n<li>In April, Israeli forces\u00a0<a href=\"http:\/\/www.maannews.com\/Content.aspx?id=774721\" target=\"_blank\" rel=\"noopener\">razed<\/a>\u00a0a school in Khirbet Tana, near Nablus, under\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-report-21-february-6-march-2017\" target=\"_blank\" rel=\"noopener\">demolition orders<\/a>\u00a0issued in March. Israeli forces had demolished the village\u00a0<a href=\"http:\/\/www.protectingeducation.org\/country-profile\/israelpalestine\" target=\"_blank\" rel=\"noopener\">school<\/a><a href=\"http:\/\/new.ochaopt.org\/sites\/default\/files\/ocha_opt_khirbet_tana_fact_sheet_20110210_english.pdf\" target=\"_blank\" rel=\"noopener\">three times<\/a>\u00a0between 2005 and 2010. Because of home demolitions in 2010, the village\u2019s\u00a0<a href=\"http:\/\/www.jmcc.org\/news.aspx?id=1195\" target=\"_blank\" rel=\"noopener\">population was nearly cut in half,<\/a>\u00a0from 56 to 27 families. After residents rebuilt the school in 2011, Israeli forces demolished it\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/wide-scale-demolitions-khirbet-tana\" target=\"_blank\" rel=\"noopener\">again<\/a>\u00a0in March 2016.<\/li>\n<li>Authorities issued new demolition orders against primary schools in three other communities:\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-weekly-report-1-14-august-2017\" target=\"_blank\" rel=\"noopener\">Arab al-Ramadin al-Janubi<\/a>,\u00a0<a href=\"https:\/\/www.nrc.no\/news\/two-more-palestinian-schools-under-threat\/\" target=\"_blank\" rel=\"noopener\">Wadi al-Siq<\/a>, and\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-weekly-report-1-14-august-2017\" target=\"_blank\" rel=\"noopener\">Khan al-Ahmar<\/a><u>\u00a0Ab al-Hilu<\/u>.<\/li>\n<\/ul>\n<p>2016<\/p>\n<ul>\n<li>Israeli forces\u00a0<a href=\"https:\/\/www.btselem.org\/facing_expulsion_blog?community=204521&amp;nid\" target=\"_blank\" rel=\"noopener\">demolished 12 buildings<\/a>\u00a0in Khan al-Ahmar Ab al-Hilu in 2016, leaving 60 people homeless. Israeli forces also\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/protection-civilians-weekly-report-24-may-6-june-2016\" target=\"_blank\" rel=\"noopener\">dismantled and confiscated two donor-funded trailers<\/a>\u00a0used as a preschool in\u00a0<a href=\"https:\/\/www.btselem.org\/facing_expulsion_blog?nid=206241\" target=\"_blank\" rel=\"noopener\">Sateh el-Bahar<\/a>, near Jericho.<\/li>\n<li>In August, Israeli forces demolished a children\u2019s recreational facility in the village of\u00a0<a href=\"https:\/\/reliefweb.int\/report\/occupied-palestinian-territory\/wrong-side-wall\" target=\"_blank\" rel=\"noopener\">Nabi Samwil<\/a>, near Jerusalem. Israeli authorities issued demolition or stop-work orders against a school\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/ocha_opt_protection_of_civilians_weekly_report_2013_11_15_english.pdf\" target=\"_blank\" rel=\"noopener\">classroom<\/a>\u00a0in the village in 2013.<\/li>\n<\/ul>\n<p>2015<\/p>\n<ul>\n<li>Israeli forces\u2019 demolitions of Palestinian water networks near East Jerusalem\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/UNICEF_State_of_Palestine_-_CAAC_Bulletin_Q1_2015.pdf\" target=\"_blank\" rel=\"noopener\">cut the water<\/a>\u00a0to a school in the Bedouin community of Arab al-Jahaleen for 10 days. Authorities issued a demolition order for a\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/UNICEF_SoP_-_CAAC_Bulletin_-_Q3_2015(1).pdf\" target=\"_blank\" rel=\"noopener\">school in Masaffer Yatta<\/a>\u00a0in the southern West Bank.<\/li>\n<\/ul>\n<p>2014<\/p>\n<ul>\n<li>In 2014, Israeli authorities issued new demolition and stop-work orders against\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/ocha_opt_protection_of_civilians_weekly_report_2014_10_17_english.pdf\" target=\"_blank\" rel=\"noopener\">four schools<\/a>\u00a0\u2013 in East Jerusalem, Hebron, Tubas, and Jaba\u2019, a Bedouin community. In\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/UNICEF_-_State_of_Palestine_-First_quarter_of_2014_CAAC_bulletin_-_final.pdf\" target=\"_blank\" rel=\"noopener\">Hebron<\/a><u>,<\/u>\u00a0Israeli forces declared one school to be a \u201cclosed military area\u201d and used another school as an overnight detention center.<\/li>\n<\/ul>\n<p>2012<\/p>\n<ul>\n<li>Israeli authorities issued demolition orders for the school in the village of Khirbet Jinba, in the southern West Bank, and\u00a0<a href=\"https:\/\/www.haaretz.com\/palestinian-school-closed-after-idf-blocks-access-to-teachers-1.5222081\" target=\"_blank\" rel=\"noopener\">confiscated<\/a>\u00a0the vehicle that teachers used to reach the school. Teachers tried to ride to the school on donkeys, but the trip was too long, and the school closed,\u00a0<em>Haaretz<\/em>\u00a0reported. The nearest school was 20 kilometers away. Khirbet Jinba is one of eight neighboring Palestinian communities whose residents the military is seeking to expel, after declaring that they fall within \u201c<a href=\"https:\/\/www.btselem.org\/index.php\/south_hebron_hills\/firing_zone_918\" target=\"_blank\" rel=\"noopener\">Firing Zone 918<\/a>,\u201d a military training area. Military restrictions and road closures\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/coercive-environment-intensified-herding-communities-southern-hebron\" target=\"_blank\" rel=\"noopener\">have continued<\/a>\u00a0to affect the area.<\/li>\n<\/ul>\n<p>2011<\/p>\n<ul>\n<li>Israeli forces\u00a0<a href=\"https:\/\/www.unicef.org\/oPt\/UNICEF_oPt_-_Annual_CAAC_bulletin_for_the_year_2011.pdf\" target=\"_blank\" rel=\"noopener\">demolished<\/a>\u00a0a classroom in\u00a0<a href=\"http:\/\/rhr.org.il\/eng\/tag\/dkeika\/\" target=\"_blank\" rel=\"noopener\">Dkaika<\/a>\u00a0village, in the southern West Bank. As of 2017 the authorities had issued\u00a0<a href=\"http:\/\/rhr.org.il\/eng\/2017\/07\/high-court-orders-state-explain-intention-demolish-palestinian-village-dkeika-expel-residents\/\" target=\"_blank\" rel=\"noopener\">demolition orders<\/a>\u00a0for 111 of Dkaika\u2019s 140 structures. Israeli forces also demolished the playground of al-Ibrahimiya School and College, in East Jerusalem.<\/li>\n<li>Military forces\u00a0<a href=\"https:\/\/www.ochaopt.org\/sites\/default\/files\/ocha_opt_fragmented_lives_annual_report_2012_05_29_english.pdf\" target=\"_blank\" rel=\"noopener\">closed roads<\/a>\u00a0to Palestinians in the northern Jordan Valley, forcing\u00a0<a href=\"https:\/\/www.ochaopt.org\/content\/access-education-area-c-west-bank\" target=\"_blank\" rel=\"noopener\">166 primary-school students<\/a>\u00a0from four communities to take detours of up to 45 kilometers, which meant that they had to spend the week in the town where the school is located, away from their families.<\/li>\n<\/ul>\n<p><strong>International Law on the Right to Education and Occupied Territory<\/strong><\/p>\n<p>Under the Rome Statute of the International Criminal Court, the widespread, unlawful destruction of property and \u201cthe deportation or transfer\u201d of people in an occupied territory are war crimes. The ICC statute went into effect for Palestine on April 1, 2015. Separately, the Palestinian government had also\u00a0<a href=\"http:\/\/www.icc-cpi.int\/en_menus\/icc\/press%20and%20media\/press%20releases\/Pages\/pr1080.aspx\" target=\"_blank\" rel=\"noopener\">lodged<\/a>\u00a0a\u00a0<a href=\"http:\/\/www.icc-cpi.int\/iccdocs\/PIDS\/press\/Palestine_A_12-3.pdf\" target=\"_blank\" rel=\"noopener\">declaration<\/a>\u00a0giving the ICC a mandate dating back to June 13, 2014, over serious crimes in Palestine. The ICC prosecutor, Fatou Bensouda, has opened a preliminary examination into potential serious crimes committed by all sides. Human Rights Watch has called on the ICC prosecutor to open a\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2016\/06\/05\/palestine-icc-should-open-formal-probe\">formal investigation<\/a>\u00a0into the situation, given strong evidence that serious crimes have been committed in Palestine since 2014.<\/p>\n<p>In April 2018, Bensouda, in the context of Israel\u2019s killing of protesters in Gaza, issued a\u00a0<a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=180408-otp-stat\" target=\"_blank\" rel=\"noopener\">statement<\/a>\u00a0noting that \u201cany new alleged crime committed in the context of the situation in Palestine may be subjected to my Office\u2019s scrutiny.\u201d<\/p>\n<p>Common article 1 to the four Geneva Conventions of 1949, including the convention applicable to situations of occupation, obliges all states \u201cto respect and to ensure respect\u201d for the obligations set forth in the conventions. States must seek to fulfill this obligation\u00a0<a href=\"https:\/\/www.nrc.no\/globalassets\/pdf\/legal-opinions\/eo-common-article-1-ihl---boutruche---sassoli---8-nov-2016.pdf\" target=\"_blank\" rel=\"noopener\">effectively<\/a>. The authoritative International Committee of the Red Cross\u00a0<a href=\"https:\/\/ihl-databases.icrc.org\/applic\/ihl\/ihl.nsf\/1a13044f3bbb5b8ec12563fb0066f226\/0cfe221042c46f8ec12563cd0042a115\" target=\"_blank\" rel=\"noopener\">Commentary<\/a>\u00a0on common article 1 says that all contracting parties \u201cmust do everything reasonably in their power to prevent and bring \u2026 violations to an end.\u201d The Fourth Geneva Convention of 1949 also obliges all countries to prosecute \u201cgrave breaches,\u201d including the wanton destruction of property and the forcible transfer of people in an occupied territory from their homes to other locations within or outside the territory. The\u00a0<a href=\"http:\/\/www.icty.org\/x\/cases\/naletilic_martinovic\/tjug\/en\/nal-tj030331-e.pdf\" target=\"_blank\" rel=\"noopener\">prohibition<\/a>\u00a0<a href=\"https:\/\/www.hrw.org\/reports\/2004\/iraq0804\/5.htm#_ftn36\">includes<\/a>\u00a0an occupier\u2019s imposition of living conditions so harsh as to effectively force people to leave.<\/p>\n<p>The UN Committee on the Rights of the Child, which interprets the Convention on the Rights of the Child, has stated that Israel must respect and apply the convention in Palestine. Under the convention, Israel is obliged to respect the right to education of everyone in the territory and ensure primary and secondary education are available and accessible to every child.
